Flip Gift Card Terms and Conditions
1. Redemption.
"Flip Gift Cards" must be redeemed through the Flip Video Online Store (store.theflip.com). Each Flip Gift Card is good for one "Flip Camcorder" (Flip UltraHD, Flip Ultra, Flip Mino or Flip MinoHD), as determined by the purchaser during the purchase process. The Flip Camcorder cannot be redeemed for any other products nor for cash. In the event that, due to changes in our models and technology, the Flip Camcorder is no longer available at the time you use this Flip Gift Card, Pure Digital will accept this Flip Gift Card in exchange for a Pure Digital product, offered through www.theflip.com, that, in Pure Digital’s reasonable discretion, comes closes to the Flip Camcorder indicated on the card. Flip Gift Cards cannot be returned, reloaded, resold, transferred for value, redeemed for cash or applied to any other account. Flip Gift Cards are issued by Pure Digital Technologies, LLC, a Delaware corporation ("Pure Digital" or "we" or "our").
2. Our Policies.
Flip Video Gift Cards are subject to the Flip Video Online Store Terms of Purchase at http://store.theflip.com/purchaseterms.aspx
3. Risk of Loss.
The risk of loss and title for Flip Gift Card pass to the purchaser upon our electronic transmission to the purchaser, recipient or delivery to the carrier, whichever is applicable. If a Flip Gift Card is lost, stolen or damaged, a replacement Flip Gift Card will be issued upon presentation of evidence of purchase (subject to a $5.95 replacement fee), and upon our confirmation that the original Flip Gift Card has not been used. Store this gift card securely. If it is used by someone else, we cannot be responsible.
4. Fraud.
We have the right to refuse the redemption of the original Flip Gift Card coupon number if we believe a fraudulently obtained Flip Gift Card is being used to obtain (or attempt to obtain) a Flip Camcorder.
5. Limitation of Liability.
PURE DIGITAL AND ITS AFFILIATES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO FLIP GIFT CARDS, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL PURE DIGITAL (OR ITS AFFILIATES) BE LIABLE UNDER THE SUBJECT MATTER OF THESE TERMS & CONDITIONS FOR ANY (I) INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES (WHETHER OR NOT FORESEEABLE), OR (II) AMOUNTS IN THE AGGREGATE IN EXCESS OF THE PRICE PAID BY YOU FOR THE APPLICABLE FLIP GIFT CARD. IN THE EVENT A FLIP GIFT CARD CODE IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND PURE DIGITAL’S SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
6. General Terms.
When you purchase, receive or redeem a Flip Gift Card, you agree that the laws of the State of California, without regard to principles of conflict of laws, will govern these Flip Gift Card Terms & Conditions. Purchases are limited to U.S. addresses. Pure Digital reserves the right to change these Term & Conditions from time to time in its discretion. The Terms & Conditions that apply to your purchase of a Flip Gift Card will be the Terms & Conditions in effect at the time of such purchase.
